Legal information
Terms of use and sale
Last updated:
These terms apply to the 2048³ game for Android, its online services (world ranking, daily challenge, token backup) and the token purchases made in the game. By installing or using the game, you accept them. The purchase conditions (sections 7 to 10) are shown to you before each purchase. This is a translation: the French version prevails.
1. Who we are
The game is published by Cassandra ROGER, sole proprietor (EI) trading as “Tian-C Studio”, 6 rue Saint Roch, 51110 Boult-sur-Suippe, France, SIREN 131 510 844, tian.c.studio@gmail.com, +33 6 17 44 00 13. Full details are in the legal notice: https://tian-c.com/en/legal
2. Definitions
- “Game”: the 2048³ application and its updates.
- “Online services”: the world ranking, the daily challenge and the token backup on our server.
- “Credits”: the in-game currency earned by playing. It cannot be bought.
- “Tokens”: the in-game currency bought with real money, through Google Play.
- “Virtual content”: customizations, boosters and other items obtained in the game with credits or tokens.
- “Recovery code”: the code shown in the game settings, which lets you get your tokens back on another device.
3. Access to the game
- The game is a free download on Google Play. It is funded by advertising and optional purchases: it can be completed without buying anything.
- A compatible Android device is required. Online services and purchases need an Internet connection; connection costs are yours.
- No account is needed. Your results are linked to an installation identifier created at random by the game (see the privacy policy: https://tian-c.com/en/privacy).
- If you are a minor, ask your parents before any purchase. Parents can require approval of every purchase in Google Play’s parental controls.
4. License
We grant you a personal, non-exclusive, non-transferable and free right to use the game for your private use, for as long as you use it. You may not:
- copy, modify, decompile or disassemble the game, except where article L. 122-6-1 of the French Intellectual Property Code allows it;
- cheat: automated programs or devices, tampering with the data sent to the server, deliberate use of a bug;
- sell, rent or exchange for money credits, tokens, virtual content or recovery codes;
- disrupt the online services or try to access data that is not yours.
5. Rankings, nickname and moderation
Your nickname and results are public: they are shown in the game rankings and on tian-c.com. Your nickname must not:
- contain your name, someone else’s, or any information that identifies a person;
- be insulting, hateful, discriminatory, sexual, violent or unlawful;
- impersonate a person, a brand or Tian-C Studio, or advertise.
Moderation: an automatic filter refuses some words. The rest is checked by us, after a report or our own checks. Results are checked automatically (signature, plausibility, daily challenge games replayed move by move).
Possible measures, proportionate to the seriousness: replacing the nickname with an automatic one, removing a result, removal from the ranking, and in case of cheating or serious or repeated misconduct, exclusion from the online services. They do not affect purchased tokens, except in case of payment fraud.
You can contest a measure or report content at tian.c.studio@gmail.com (procedure: https://tian-c.com/en/legal#signalement). We reply with the reasons for our decision when we have a way to contact you.
6. Advertising and rewarded videos
- The game shows ads provided by Google AdMob. Consent to personalized advertising and its withdrawal are described in the privacy policy.
- Some videos are optional and give an in-game reward. The reward is only granted if the video is watched to the end. If no video is available, no reward is due.
- Ads are chosen by Google, not by us. If one seems inappropriate to you, report it to tian.c.studio@gmail.com.
7. Tokens and virtual content
- Tokens, credits and virtual content are rights of use within the game. They have no monetary value and cannot be refunded in money (except where the law and these terms provide), exchanged or transferred to another player.
- The price of each token pack is shown in euros (or your local currency), all taxes included, before purchase. In the shop, the token price of each item is shown before you take it, and you can buy the pack that matches your needs.
- Tokens do not expire as long as the game and its online services are operated.
- Tokens are saved on our server and linked to your recovery code. Keep this code to yourself: anyone who uses it can take the tokens. If you lose it, we can help you on presentation of the Google Play order number (GPA.…) on your receipt.
- Spending tokens requires an Internet connection and is final once confirmed.
8. Order and payment
- Purchase steps: choice of a pack in the game shop, display of its content, its price and the information on the right of withdrawal, then confirmation and payment in the Google Play window.
- Payment is collected by Google Play, under Google Play’s payment methods and terms. We never have access to your banking details.
- After payment, our server checks the purchase with Google and credits your tokens, usually immediately. Google sends you a receipt by email with the order number. These terms remain available at any time at this address and can be saved or printed.
- If your tokens do not appear, restart the game with a connection: the purchase is sent again automatically. Otherwise, write to us with the order number.
9. Right of withdrawal
As a rule, you have 14 days to withdraw from a distance purchase. This right does not apply to digital content supplied immediately when you expressly requested this supply and waived your right of withdrawal (article L. 221-28, 13° of the French Consumer Code).
As tokens are credited as soon as payment is confirmed, the game asks you, before each purchase, to confirm that you request their immediate supply and acknowledge that you lose your right of withdrawal. Without this confirmation, the purchase is not offered.
If, for any reason, this confirmation was not collected, you keep your right of withdrawal for 14 days from the purchase. To exercise it, send a clear statement to tian.c.studio@gmail.com, for example with the form in section 16. We acknowledge receipt by email, remove the corresponding tokens and refund you, or have Google Play refund you, within 14 days, using the same means of payment.
Independently of these rules, Google Play applies its own refund policy, which you can use directly from your Google Play account.
10. Legal guarantees
We are responsible for the conformity of the tokens and digital content supplied. In case of a problem (tokens not credited, purchased content unavailable, a bug preventing their use), write to us: we fix it free of charge or, failing that, refund you.
If a purchase is refunded (by Google Play, by us, or after a bank dispute), the corresponding tokens are removed from your balance, up to what it holds.
Box: legal guarantee of conformity of digital content
The consumer has two years from the supply of the digital content or digital service to claim the legal guarantee of conformity if a lack of conformity appears. For one year from the date of supply, the consumer only has to prove the existence of the lack of conformity and not when it appeared. When the contract provides for continuous supply of the digital content or digital service for a given period, the guarantee applies throughout that period and the consumer only has to prove the existence of the defect.
The legal guarantee of conformity obliges the trader, where applicable, to supply all updates necessary to keep the digital content or digital service in conformity.
The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following the request, free of charge and without significant inconvenience.
The consumer can obtain a price reduction while keeping the digital content or digital service, or end the contract and obtain a full refund in exchange for giving up the digital content or digital service, if: the trader refuses to bring it into conformity; bringing it into conformity is unjustifiably delayed; it cannot be brought into conformity without costs for the consumer; bringing it into conformity causes significant inconvenience to the consumer; the lack of conformity persists despite the trader’s unsuccessful attempt to remedy it.
The consumer is also entitled to a price reduction or to terminate the contract when the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer then does not have to request conformity first.
Any period during which the digital content or digital service is unavailable in order to be brought into conformity suspends the remaining guarantee until the conforming digital content or digital service is supplied again.
These rights result from articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code. A trader who in bad faith obstructs the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L. 242-18-1 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in exchange for giving it up.
11. Availability and evolution of the game
- We do our best to keep the online services running continuously, but interruptions may occur (maintenance, outage of the host or of Google, update).
- The game evolves: we may add, change or remove modes or content. Content bought with tokens remains usable, or is replaced by equivalent content.
- If we had to permanently shut down the online services, we would announce it in the game at least 3 months in advance, stop selling tokens from the announcement, and your tokens would remain usable until the shutdown date, without prejudice to your statutory rights.
12. Liability
We are responsible for the proper performance of these terms, within the limits set by law. We are not responsible for damage caused by use of the game contrary to these terms, by a faulty device or connection, by your own disclosure of your recovery code, or by force majeure. Nothing in these terms limits your rights under the legal guarantees or the mandatory provisions of consumer law.
13. Your data
The data used by the game, your rights and the “Delete my data” button in the settings are described in the privacy policy: https://tian-c.com/en/privacy
14. Duration, changes and termination
- These terms apply as long as you use the game. You can stop at any time: uninstall the game and, if you wish, delete your data from the settings.
- We may change these terms, for example to follow the law or an evolution of the game. Significant changes are announced in the game before they take effect. The terms applicable to a purchase are those in force at the time of that purchase.
- In case of a serious breach of these terms (cheating, illegal content, payment fraud), we may suspend or remove your access to the online services, after informing you when possible.
15. Complaints, mediation and governing law
For any complaint, write to tian.c.studio@gmail.com with your nickname and, for a purchase, the order number. We reply within 15 days at most.
If the disagreement persists, you can refer it free of charge to the consumer mediator: CM2C, Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France, https://www.cm2c.net. The mediator can only be contacted after a written complaint to us, and within one year of it.
These terms are governed by French law, without depriving you of the protection of the mandatory rules of your country of residence. In case of dispute, you can go to the court of your place of residence or any other court competent under the law.
These terms are written in French; the English version is a translation, and the French version prevails in case of difference.
16. Model withdrawal form
Only if your right of withdrawal applies (see section 9). Send it to tian.c.studio@gmail.com:
